Filing a motion for child support, i dont work but my current husband does, do i count that as my income?
him and his girlfriend both work, and receive welfare, but they say i dont put her income, even though they live together and have a child together. but yet they want my income. anyone went through this before? i am in wichita kansas, just wanting a dead beat dad to pay for his children as my current husband pays everything for them. will be open to all answers!!!

No you don't count your current husbands income nor does your ex count his girlfriends income. Contact the Child Support agency in your county and ask them these questions.

The only income which is taken into consideration is yours and your ex husband's. A girlfriend or new spouse doesn't count. She is not responsible to pay for your kids. Your kids do not belong to her. Yes they want YOUR income, you are the mother...

If you remarry you won't be entitled to any alimony. Your husband's income has absolutely nothing to do with your ex paying child support. You can't count his girlfriend's income because they aren't married. She can simply walk away from him at any time. That's how the courts view her. The courts would consider the child he has with her when they calculate his support payments.

they won't count either spouses income in calculating support, but sometimes they do ask for it if the judge wants to factor in which tax bracket each party falls into and/or if each parent has help paying the household expenses. but the bottom line is only the two parents actual earned income is counted in calculating a dollar amount for support.

Child support is only between the biological mother and father of said child and their incomes only no matter whether theyre remarried or not. The new spouse or girlfriends/boyfriends or new husbands incomes do not ever enter the equation here at all. So if you dont have any income yourself then report it as no income at all

No because he is not responsible for your kids. Your ex is. If he doesn't pay, his wages will be garnished. Why wasn't this taken care of during the divorce?

You can't get a dime from his gf. If you have custody in the court papers then you should be able to get child support.

His girlfriend's income doesn't matter. She did not get you pregnant. He did. You and this man made the child who needs the support order. So the income they want on the form is his and yours. Just in case they consider your tax bracket and need your husbands to determine that, simply call the court clerk for the family court you are filing in and ask. They will be happy to help. Well, maybe not happy, but they will help.

It depends on if your state is a community property state and if they consider common law marriages after a certain time of residing together in the same home. My friends husband was on welfare and when they went to court, they granted her child support off of what the minimum wage was in our state and gave him a certain amount of time to get a job before they put him in jail for being a dead beat dad. The judge said he believed he wasn't working just so he didn't have to support his first kid. He, too, had another child and was active in his life. I don't understand how one child can be more important than another because I have four beautiful children.

Why don't you have a job? It's not your current husband's job to support your children. That responsibility belongs to you and your children's father. If neither one of you are supporting the children, then that pretty much makes both of you dead beats! Since you don't work, then the answer is no, you don't have any income, your husband supports you.

Your child support is based on your income and that of the ex spouse. No one else. The state sets the amount. So much per child per week. Your income is $0. He will have to pay the full amount per week according to the state tables.
